Thompson, Appellee; Transcript of Record; Appeal From the United States Circuit Court for the District of Washington, Northern Division Your orator further shows that in pursuance of said ordinance No. 1285 said the City of Seattle on or about the 1lth day of February, 1890, entered into a contract with one A. Peek for the improvement of said Weller street and Weller street produced extending from said Fifth street across said private property comprising said hundred acre tract a distance of about feet to the west boundary of said Jackson street addition; that said contract provided for the grading and grubbing and the building of a sidewalk on each side of said Weller street and Weller street so produced from said Fifth street to the said Jackson street addition and provided for the construction of an elevated roadway 32 feet wide, built of lumber and iron and supported on wooden piles, and extending from said Fifth street east to a point 70 feet west of the west line of South Ninth street a distance of about feet, said improvements being contracted for with the intention on the part of said city to assess the whole cost thereof on the property abutting on said improvements.
